Collective redundancy of managers and ban of dismissals due to covid-19 pandemic

A comment by Francesco Pedroni for Lexology – ILO International Labor Office on two diverging decisions of the Court of Milan issued on 2 July 2021 and 17 July 2021. The cases are related to dismissals of executives during the ban to the dismissals due to Covid pandemic. Both of the Court’s decisions stemmed from the assumption that the verification of the requirements to activate the collective dismissal procedure should be conducted when the dismissal decision is made, but deverge in the consequences applied.
